Mithat is the founding partner of TERCAN LEGAL. He has significant experience in banking, infrastructure and corporate dispute resolution and restructuring matters.
He has extensive experience working on project development and finance transactions in the areas of power, oil and gas, ports, metals & mining and general infrastructure. Mithat, has a very unique banking, real estate and energy practice in Turkey; he has been involved in many different aspects of the Turkish banking sector. His expertise in the sector embraces debt capital markets transaction, structured finance, project finance, corporate finance, derivatives, syndicated loans, bilateral borrowings, general banking law, Turkish law of foreigners and foreign direct investments. He assists clients in avoiding or resolving disputes and regulatory issues through negotiation, mediation, arbitration and litigation. His experience embraces international commercial and investment treaty arbitration. His LL.M. thesis entitled Examining the role of amicus curiae arbitration in the ICSID arbitration. His PhD thesis is focusing on the Immunity of International Economic Organizations Under International Law.
Mithat has been worked as a in house counsel for several leading Turkish Bank that has an subsidiary of international finance groups. Also he represented (both in the restructuring process and execution process) the debtor side in one of the biggest and well known banking disputes of Turkey amounted 800.000.000 USD.
He publishes, teaches and speaks extensively on arbitration and banking and Turkish law of foreigners matters.
